Lasting Power of Attorney

If you were to become incapacitated due to illness or an accident you may not be able to deal with your affairs.  Without a Lasting Power of Attorney it can be expensive and time consuming for family members to obtain permission to deal with your affairs to act on your behalf.  

A film produced by the BBC for The One Show highlights the difficulties a wife experienced when her husband was involved in an accident, as no Power of Attorney had been registered.  It demonstrates the issues that can arise and how a Lasting Power of Attorney could have prevented them.  The cost to register a Power of Attorney form has since been reduced to £82. However, some people may qualify for fee exemption or remission depending on household income and benefits received.  As a Certificate Provider we offer a home visiting service in the Somerset Area and oversee the completion and registration of your Power of Attorney form, ensuring its validity.  



There are two types of Lasting Power of Attorney

  • Health and Welfare (Medical & Welfare Wishes)
  • Property & Financial Affairs (Someone operate your bank accounts, pay your bills and deal with financial affairs on your behalf)

The person or persons who will act for you under the Lasting Power of Attorney must be selected carefully as they will be able to act on your behalf.  You need to be certain they can be trusted with your finances and will operate in your best interest.  

Attorneys have to be over 18 but can live overseas. Attorneys can act jointly or jointly and severally, according to your decision.   We will explain the options to you and complete the registration documents according to your wishes.  

The forms have to be signed by you (the donor), the attorney/s and a certificate provider such as ourselves – Guardian Protect.  Signatures must be witnessed for the document to be valid.   Attorneys are not permitted to witness your signature.

If the Donor and Attorneys are present for the signing of the document in the same meeting then we charge a fee of £199 for our services as Certificate Provider for each LPA required (Property & Finance / Health & Welfare).  

For each attorney not present at the signing, we must either send the completed LPA form to them by Special Delivery OR make an appointment to visit them at a suitable time.  We charge an additional £50 for each attorney to cover the additional work this entails.

Some people only wish their spouse to be their attorney.  Although this option has its limitations it does offer reassurance to couples who do not wish family members to be attorneys.
